This article covers the situation of open access, academic digital magazines in Spain and Mexico. It analyzes the steps taken by the public institutions aimed at regularizing the proposals resulting from the different casuistic and special attention is focused on the ethical aspects affecting the publication of scientific articles. Open Access, which is intended to promote digital academic publications, should consider the ethical aspects relating to authorship and the archives where the articles are kept. As a result, it is necessary to maintain a constant vigil to avoid intrusion and access by “predatory magazines”. It is concluded that clearly defined policies for action have to be set up that will inform the author of the scientific value of the digital journals, the formation of the archives and the licenses for use in each case.
